#Quebec’s #CourtOfAppeal has upheld a landmark 2022 decision that found a law permitting random traffic stops by police led to #RacialProfiling.

The province’s high court agreed with a #SuperiorCourt ruling that declared inoperative an article of the province’s #HighwaySafetyCode that allows #police to randomly stop drivers without a reasonable suspicion that an offence has been committed.

Das dreiköpfige Richtergremium des #SuperiorCourt, bestehend aus dem vorsitzenden Richter Jack Panella (Demokrat), Victor Stabile (Republikaner) und dem emeritierten vorsitzenden Richter John Bender (Republikaner), erließ ein 23-seitiges Urteil, in dem es die Weigerung der Richterin am #Philadelphia #CommonPleas, Lucretia Clemon, bestätigte, eine Beweisaufnahme zu gewähren.

Das Gericht bestätigte Clemons' Meinung, dass das Gericht aufgrund von Verfahrenshindernissen nicht befugt sei, die ihm vorliegenden Ansprüche zu prüfen. Um das Gericht zu zitieren: "Der [unterdrückte] Brief war kein Anklageerhebungsmaterial oder entlastend", und die Vorvernehmungsnotizen "zeigen keine unangemessenen Beweggründe für den Ausschluss von Geschworenen".

A #SuperiorCourt judge has approved a $65-million #settlement between former residents of a #QuebecCity #orphanage and a religious order and a local #health authority.

Justice #DanielDumais rendered a decision last week approving the class-action settlement reached for victims of the #Mont DYouville orphanage.

The settlement is the largest in Quebec history for an abuse class action, the judge noted in his ruling.

I was adding something to my phone's calendar, and saw that it had been a year since I was last called for jury duty. When looking up how often you can be summoned in GA, I discovered a little quirk: the rule is not that you can only be summoned once a year, but rather, that you can be summoned whenever they update the jury pool list, which is once a year. So, you could be called twice in a calendar year. This seems unfair.

From Fulton County: "Jurors are eligible to be summoned for jury duty every time a new juror master list gets uploaded to our jury management system, which is once a year."

For those in the U.S. what are the rules regarding how often you can be summoned in your state? Also, how much/how do you get paid? In Fulton County Superior Court, the rate has not changed since I first served in 1994: $25 per day, in a check mailed to you after you complete your service. (I think State Court is even less.) Your employer is required to continue your regular pay during this time, but only if you are salaried (and they can legally deduct your jury pay from your salary). The unsalaried or unemployed are SOL.

The first time I served, I couldn't afford to buy lunch. It was humiliating.

#McGill #University has been denied in its request for an #injunction to have the pro-#Palestinian encampment removed from the field on its lower #campus.

After hearing arguments on the matter on Monday, #Quebec #SuperiorCourt Justice #MarcStPierre denied the request Wednesday morning. The judge suggested that the school modify its request and file it to court within the next 10 days.
