The outcome was expected: Last week, in an 18-page decision, Justice #Merchan said that he planned to give #Trump an #UnconditionalDischarge, writing that it “appears to be the most viable solution to ensure finality.”
Trump, who was convicted of 34 felony counts of falsifying business records to cover up a sex scandal, had originally faced probation or up to 4 years in prison, & Justice Merchan had ample ground to consider incarceration.

On Friday, Justice Juan M. #Merchan sentenced Donald J. Trump to an #UnconditionalDischarge, a rare & lenient sentence in NY state courts that still cements #Trump’s status as a #felon before his inauguration.
A conditional discharge would have required him to meet certain conditions, like maintaining employment or paying restitution, but Trump will not be subject to any requirements going forward.

…last wk, #Merchan wrote that he plans to order an “unconditional discharge” for #Trump, a designation in NY #criminal courts for a non-jail & non-probation sentence….
…the current sentencing schedule was requested by Trump, who previously asked for the hearing to be postponed until after the election that Trump maintained he would win. After making that request, the judge said Trump could NOT now credibly say that winning the election makes him #immune from #sentencing.

Even though Justice #Merchan has signaled that he will spare the former & future president any substantive punishment, #Trump is scrambling to avoid the symbolic blow of sentencing. Once Trump is sentenced for the 34-count #conviction, he will formally become a #felon.

Although that request is most likely doomed — the judge, Juan M. #Merchan, was the one who scheduled the sentencing — #Trump’s lawyers disclosed in the filing that they planned to escalate their effort. If the judge does not pause the sentencing by 2PM on Monday, the filing said, Trump will “seek an emergency appellate review.”
Hoping to persuade a NY appeals court to intervene, Trump’s lawyers plan to file a civil action against Justice Merchan & seek to freeze the sentencing….

At the same time, we must also note how extraordinary it is for any judge to render a decision against a former president in a #criminal matter, especially... as he prepares to take office for a 2nd term.

Judge #Merchan on Monday rejected #Trump’s argument that a recent #SCOTUS ruling had nullified his #criminal case in New York, upholding the former & future president’s felony conviction for falsifying records to cover up a sex scandal.
The judge’s ruling preserves, at least for now, the stain of Mr. Trump’s criminal conviction. And if it withstands Mr. Trump’s appeal, it will make him the first #felon to serve as president.
