"Discussion of legislation to afford the Wabanaki Nations more authority over their land revealed that Gov. Janet Mills does not support the change, presenting a steep path for a plan that otherwise has bipartisan support.

"After not testifying during the public hearing last week, the governor’s counsel, Jerry Reid, told the Judiciary Committee on Wednesday that Mills’ concerns stem from the inability to predict the future needs of state government, an issue also raised in written testimony from the #MaineDepartmentOfTransportation, which was made available after the hearing.

"When pressed by committee members, Reid said he doesn’t have a specific example of an infrastructure project that would warrant seizing tribal land but that, 'We need to write the law mindful of the potential for problems.'

"While Reid and Wabanaki leaders noted that progress has and continues to be made to improve the relationship between the state and Wabanaki Nations, Reid added, 'the fact that we have such a good relationship right now might not always be true.'

"The U.S. government can seize private property for public use, a principle known as eminent domain, however that authority is restricted by the Fifth Amendment of the U.S. Constitution, which requires just compensation for land taken, as well as some federal laws.

"The 1834 federal Indian Nonintercourse Act prohibited land transactions with tribes unless authorized by Congress. However, the 1980 Maine Indian Claims Settlement Act specified that that federal law was not applicable to the #HoultonBand of #Maliseet Indians, the #PassamaquoddyTribe and the #PenobscotNation.

"This is the act that has overall resulted in the Tribes being treated more akin to #municipalities than #SovereignNations. So far, sweeping changes to the act have failed due to opposition from Mills, but the governor, lawmakers and Wabanaki leaders have successfully made some targeted adjustments, including expanding tribal authority to prosecute crimes last year.

"The legislation being considered this session, #LD958, would amend the Settlement Act to prohibit the state from exercising eminent domain on trust and reservation land, which is protected under federal law, though fee land — or private property for which the owner owns the title — would still be subject to the state taking.

"The bill would also amend the 2023 #MikmaqNationRestorationAct to make this change for the Mi’kmaq Nation, which wasn’t included in the Settlement Act.

"On Tuesday, the Taxation Committee unanimously voted in favor of a bill to ensure equal tax treatment among all of the Wabanaki Nations, which Mills supports. #LD982 would provide the #MikmaqNation the same rights to sales tax revenue on its land that the other three tribes of the Wabanaki Nations were granted in 2022 through an amendment to the Settlement Act.

Bipartisan lawmakers, Wabanaki leaders propose next change to Settlement Act

"A bipartisan group of lawmakers presented legislation on Friday to prevent the state from being able to seize #Wabanaki land for public use without consultation.

"For the past several Legislative sessions, leaders of the Wabanaki Nations have worked with lawmakers to try to overhaul the 1980 #MaineIndianClaimsSettlementAct that has resulted in the tribes being treated more akin to municipalities than #SovereignNations.

"So far, sweeping change has failed due to opposition from Gov. #JanetMills, but the executive, lawmakers and Wabanaki leaders have successfully made some targeted adjustments, including expanding tribal authority to prosecute crimes last year.

"#LD958 represents the next area of focus, although an omnibus bill is still expected to be considered during the second regular session of the Legislature next year.

"Sponsored by House Minority leader Billy Bob Faulkingham (R-Winter Harbor) and bipartisan co-sponsors, LD 958 would amend the #SettlementAct and the 2023 #MikmaqNationRestorationAct — as the Mi’kmaq Nation hadn’t been included in the earlier act — to prohibit eminent domain, a protection already afforded to almost all other federally recognized tribes.

" 'Much of our land contains irreplaceable cultural, spiritual and ecological resources,' said #Passamaquoddy Tribal Rep. Aaron Dana, a co-sponsor of the bill who sits on the Judiciary Committee. 'This bill ensures those places are safeguarded and are not subject to #destruction or #appropriation. Too often in our history, our #TribalLands have been taken, divided and exploited under the guise of progress.'

"The U.S. government can seize private property for public use, known as eminent domain, however that authority is restricted by the #FifthAmendment U.S. Constitution, which requires just compensation for land taken, as well as some federal laws.

"Rep. Rachel Henderson (R-Rumford), a co-sponsor who sits on the Judiciary Committee, questioned whether the bill is in conflict with the Constitution. It is not, Faulkingham, tribal leaders and attorneys explained, because the Constitution outlines when eminent domain can be exercised but not that it can’t be further restricted.

" 'There’s nothing in the Fifth Amendment that prohibits a state from enacting laws that says we won’t do that,' Faulkingham said.

"LD 958 applies to land protected under federal law — trust and reservation land — but fee lands — private property for which the owner owns the title — would still be subject to state power of eminent domain. A constitutional amendment allows states to condemn individually owned plots within tribal reservations.

"Maine has seized Wabanaki land from the start of their intertwined histories, as the state territory today had first been inhabited by the Wabanaki people."

#EPA to Relocate Toxic #UraniumMine Waste from #NavajoNation

"The Environmental Protection Agency will move #uranium mine waste from #ChurchrockNewMexico to the #RedRock regional landfill where it can be safely stored forever.

"The federal agency signed an action memo to transport radioactive waste at the Quivira Mining Co. Churchrock Mine to a disposal site at the Red Rock regional landfill about six miles east of the Village of Thoreau. The cleanup will begin in early 2025 and continue for 6-8 years.

"For the Red Water Pond Road Community Association (#RWPRCA), which has advocated for waste removal since 2006, the decision marks a significant shift in addressing #UraniumContamination on Navajo land.

"'Removing the mine waste from our community will protect our health and finally put us back on a positive track to #Hózhǫ (balance),' said Teracita Keyanna, RPWPRCA executive committee member. 'I think this decision empowers #grassroots organizations like ours and our allies to continue to advocate and educate to clean up hundreds of abandoned uranium mines that threaten our #Diné communities every day.'

"RWPRCA President Edith Hood said the community has dealt with the impact of uranium mining since the late 1960s. Commercial mining began at the site under #KerrMcGee Corporation, which later became the #QuiviraMiningCompany. The operation extracted an estimated 1.3 million tons of uranium ore before closing in 1986. The Navajo Nation currently has more than 520 documented #AbandonedMines, with no disposal facilities for uranium waste within 350 miles of #TribalLands.

"'Many of us suffer chronic health problems and a degraded homeland as a result,' Hood said. 'We advocate for a regional approach to addressing remediation of nearly 100 abandoned uranium mines in the Eastern Navajo Agency. We are committed to making sure the removal of mine waste from our community does not threaten the health and safety of our Diné neighbors.'

"Previous attempts to address the waste proved unsuccessful. In 2011 and 2013, the EPA and the Nuclear Regulatory Commission approved a plan to place 1 million cubic yards of waste from NECRM on top of the existing tailings pile located half a mile from RWPRC village. Effectively, neither of those wastes were removed from the communities.

"The #RedRockLandfill currently handles municipal waste from McKinley and Cibola counties and Navajo Nation communities as far away as Tuba City. The planned #UraniumDisposalCell will occupy a separate area of the 640-acre site adjacent to the shuttered #Escalante power plant.

"The Northwest New Mexico Regional Solid Waste Authority (#NNMRSWA), which owns the landfill, must show that its operations can protect #GroundWater, air and soil, while safeguarding public health for decades to come. The New Mexico Environment Department will oversee long-term monitoring of the site.

"Chris Shuey, who has documented mining and #milling impacts in the #Churchrock area for 40 years as an environmental health specialist at Southwest Research and Information Center in Albuquerque, said relocating uranium waste is essential for tribal communities.

"'Removing mine wastes from Navajo communities to engineered, regional disposal sites is a #PublicHealth imperative,' Shuey said, noting that more than half of all Navajo chapters have at least one source of unhealthy uranium exposure. 'The federal government must continue looking for suitable sites for long-term disposal of mine wastes to protect current and future Navajo populations.'

"'This decision will remove over 1 million cubic yards of waste that has haunted the #RedWaterPondRoad and #PipelineRoad communities for too long,' EPA Pacific Southwest Regional Administrator Martha Guzman said in a statement.

"'This solution is a compromise that will get #RadioactiveWaste in this area off of the Navajo Nation as soon as possible,' Navajo Nation President #BuuNygren said in the EPA statement. 'It’s not everything the three affected communities would wish for but it’s action in the right direction now rather than in the future. Most importantly, this will protect our people from harmful exposure.'"

"Lynn Amakehs (butterfly) Mitchell, #Passamaquoddy citizen and #Maine Indian Education Facilities Manager, is deeply committed to preserving her community's culture. Her unwavering dedication has earned her different awards, recognizing her service to her community and her passion for preserving language and culture. In September, Lynn was honored with the prestigious 2024 National Indian Education Association Community Service of the Year Award. This award recognizes Native community members who are role models and have served their community.

"Lynn’s journey to become a teacher and active community member is a testament to her passion and dedication. It all began when she became a mother and started participating in school and community activities. Lynn’s involvement in organizations like the Girl Scouts and PTP (Parent Teacher Partnership) marked the beginning of her service to the community before she started her decolonization work and focus on culture and language.

"Her #decolonization journey deepened after she attended the #UpstanderAcademy, where she met a #Micmac woman and spiritual healer from Canada. Their time and conversations inspired her to learn more and share what she knew, leading her to become the community leader she is today.

"After attending the Upstander Academy, Lynn's commitment to promoting cultural engagement intensified. She traveled to different tribal gatherings and immersed herself in culture as much as possible. She aimed to share her experiences and knowledge and motivate others in her community to participate in and learn cultural activities.

"Lynn plays a pivotal role in nurturing a sense of community and togetherness. She does this in various ways, including by planning community gatherings. Lynn planned a large cultural gathering that the Passamaquoddy hosted, but after much planning and organizing, she became ill and could not attend. She said that her falling ill was a 'blessing in disguise' because it resulted in something beautiful…. community members who usually do not participate in community activities took the lead and ensured the gathering went as planned. These individuals continue to be active community members, a testament to Lynn's success in promoting cultural engagement.

"One of Lynn's most significant contributions is mentoring youth, a responsibility she takes very seriously. In community service projects with youth, she saw how they responded positively, which deepened her desire to do more. These projects demonstrate her commitment to the future of her community.

"Currently, Lynn is mentoring a group of girls through their rights-of-passage ceremony. One activity the girls completed was learning how to honor berries. The girls picked berries and then gave some to the elders when they visited. The girls spend much time with the elders, learning from and talking with them. Lynn's commitment to passing this knowledge on to the next generation provides hope for the community’s ability to preserve tribal culture.

This is Lynn's 38th year working for Maine Indian Education. Since being hired, she obtained a bachelor’s degree in College Studies, focusing on Native Studies from the University of Maine at Machias. She enjoyed her courses, and what she learned provided her with the knowledge and skills needed to create the curriculum and served as a basis for the content she uses in her classes.

"Lynn began teaching the #PassamaquoddyLanguage at Calais High School before she graduated. Her classes are extremely popular and usually have a waitlist. Lynn was surprised when her classes began to have a waitlist, but anyone who knows Lynn was not surprised. Her positive energy and love radiate from her and draw people to her. Her dedication to her students and community makes Lynn a perfect recipient of the NIEA Community Service of the Year Award.

"The #NIEAConvention was established to mark the beginning of a national forum for sharing and developing ideas and influencing federal policy. #NIEA was founded in 1969 and incorporated in 1970 to meet the needs of educators, students, and the community. NIEA held its first 'First Convocation of American Indian Scholars' at Princeton University in 1969. During this meeting, several Native educators discussed concerns and issues related to the education of Native children. For many educators, this large meeting was the first opportunity to share, discuss, and learn about ideas critical to Native Americans in the United States.

"Several Natives who attended that gathering wanted an opportunity to continue the dialogue and share ways to improve education. They desired to explore ways to become more effective teachers and better school administrators and discover practical experiences that could improve schools serving Native students.

"Since its incorporation, NIEA has become a massive organization committed to addressing various issues that Native Americans face. These issues include Boarding School Healing, #NativeLanguage Initiatives, and #CulturallyBasedCurricula. NIEA’s mission is to advance comprehensive, culturally based educational opportunities for #NativeAmericans, #AlaskaNatives, and #NativeHawaiians. The organization advocates for policies and creates programs that support self-determination and the development of comprehensive, culturally grounded learning opportunities for Native students.

"National recognition through the NIEA Community Service Award underscores Lynn’s exceptional contributions to Native education and her dedication to serving the community. WASHINGTON – "Seven states that rely on the Colorado River each got a cut of its water under a deal struck over a century ago – a deal that excluded the #Hopi, the #Navajo [#Diné] and other tribal nations.

"After years of pressure and negotiation, Congress is moving to rectify what the tribes have long seen as an #injustice that has caused enormous hardship.

"'We’re closer than we’ve ever been before in reaching a final settlement,' Bryan Newland, assistant secretary for Indian Affairs with the Department of the Interior, told a Senate hearing on Wednesday.

"Representatives from four Arizona tribes – the #YavapaiApacheNation, Hopi, #SanJuanSouthernPaiute and the Navajo Nation – said the settlements, once approved by Congress, will secure their long-standing claims and provide more accessible water for their people.

"Almost a third of members of the Hopi, Navajo and other tribes have no #RunningWater, and leaders say the water currently available isn’t sufficient for growing populations.

"'Congress must act to end the water crisis on the Navajo Nation,' said Navajo Nation President #BuuNygren, who recalled that he didn’t have running water until he went off to college at Arizona State University.

"The water insecurity crisis has been felt for generations, he said.

"Navajo people sometimes have to haul water for over 30 miles, a costly and time-consuming exercise.

"The #YavapaiApacheNation #WaterRightsSettlementAct of 2024 and the #NortheasternArizona #IndianWaterRightsSettlementAct of 2024 would provide funds for pipelines and other infrastructure. The bills would also impose pumping restrictions to ensure that #groundwater is not depleted.

"The process has been slow. The #GilaRiver Adjudication process started over 50 years ago.

"Disputes over the Colorado River stem from a 1922 compact between #Arizona, #California, #Colorado, #Nevada, #NewMexico, #Utah and #Wyoming.

"'Without the settlement, a cloud of uncertainty will remain over tribal water claims in the Colorado River basin and tens of thousands of tribal members will continue to struggle to meet their basic needs,' said Sen. Mark Kelly, a Democrat who introduced the settlement bills with fellow Arizona Sen. Kyrsten Sinema, an independent.

"The Northeastern Arizona Indian Water Rights Settlement Act of 2024 would address claims to water from major stems of the Colorado River and Colorado River basin, providing running water to many Navajo and Hopi people.

"It also sets aside 5,100 acres near Tuba City and another 300 acres in Utah to create a reservation for the San Juan Southern Paiute Tribe.

"'The mental-emotional impact of being a landless, homeless tribe is something I wouldn’t wish upon anyone,' said Johnny Lehi Jr., the tribe’s vice president."

"#CopperMining is targeting San CarlosApache's sacred #OakFlat; #Hualapai are suing the US Department of Interior to halt lithium mining at their sacred spring Ha'Kamwe'; and the U.S. government is promoting the ongoing digging into the #Paiute Massacre Site in northern Nevada for #lithium, in violation of all federal laws that protect Native religious and historic sites, the environment and endangered species.

"Uranium mining in the Grand Canyon threatens #Havasupai's aquifer, the haul route endangers everyone in the Four Corners region, and the uranium mill at White Mesa Ute in #Utah is poisoning #Utes.

"Interior Sec. #DebHaaland said in Farmington, N.M., that Los Alamos Labs would be the leader in the so-called '#GreenEnergy transition' in the #FourCorners region.

"More than 500 radioactive #UraniumMill sites remain on the #NavajoNation that have not been cleaned up by the U.S. #EPA, which deceives the public by announcing plans and promises to clean up the #ColdWar sites.

"In the current federal lawsuit, a federal judge in South Carolina ruled that U.S. energy officials illegally neglected to study impacts to the #environment in efforts to increase plutonium production for nuclear weapons in New Mexico and South Carolina.

"'South Carolina District Court Judge Mary Geiger Lewis sided with environmental, #AntiNuclear proliferation and community groups last week who sued the National Nuclear Security Administration (#NNSA), which oversees the nuclear weapons stockpile as part of the U.S. Department of Energy [#DOE],' reports Source New Mexico.

"The U.S. is investing billions into restarting the manufacture of #PlutoniumPits, the grapefruit-sized spheres developed for #nuclear weapons. The plutonium is produced from uranium.

"'The federal government halted its manufacturing program at the #RockyFlatsPlant in #Colorado in 1989 after an FBI raid due to safety concerns and #EnvironmentalCrimes,' Source New Mexico reports.

"The U.S. government's #AtomicBombTesting in #Nevada left a trail of cancer and death for #WesternShoshone. The documentary 'Downwind' reveals the truth.

"'This is a very serious issue and that's why I can't let it go. I can't move on. People say, 'oh, why don't you just let it go?' Because it's killing my family. It's killing my land. It's killing my people. And that will not stand. It's being done in secret. And killing Indians in secret will not stand,' said Ian Zabarte, Principal Man of the Western Bands of the #ShoshoneNation of Indians. Zabarte is featured in '#Downwind' about radiation poisoning from U.S. #NuclearTests.

"Currently, foreign companies -- which receive the profits and find it easy to avoid clean up and responsibility for #environmental crimes and deaths from #cancer -- are receiving the mining leases from the U.S. government. The leases are granted by the U.S. Interior's Bureau of Land Management (BLM) and in the case of #UraniumMining in the #GrandCanyon, it is the USDA's Forestry Service. #Biden's attorneys have joined the lawsuit with #RioTinto to devastate #OakFlat.

"Australian and Canadian mining corporations are devastating Native lands and communities, poisoning the water and causing widespread cancer.
Rio Tinto, targeting Apaches #OakFlat, is an Australian company which destroyed 46,000 years of #Aboriginal sacred history in caves in #Australia.

"Another Australian mining company is targeting #Hualapai's sacred site. It is #Hawstone / #ArizonaLithium, in Perth, Australia.

"#EnergyFuels, now uranium mining in the Grand Canyon, and operating the uranium mill at #WhiteMesaUte, is a Canadian company. Another Canadian company is digging into the #Paiute Massacre Site. It is #LithiumAmericas.

WASHINGTON – "A coalition of #WesternApaches, other #Native peoples, and non-Native #allies asked the #SupremeCourt today to protect their sacred site at #OakFlat from destruction by a multinational mining giant. In Apache Stronghold v. United States, the Ninth Circuit Court of Appeals refused to stop the federal government from transferring Oak Flat to #ResolutionCopper, a foreign-owned mining company that plans to turn the site into a massive mining crater, ending #Apache religious practices forever (Watch video linked below to learn more).

"The Apaches and their allies hosted a day of prayer outside the Court as they asked the Justices to save the spiritual lifeblood of their people.
Since time immemorial, Western Apaches and other Native peoples have gathered at Oak Flat, outside of present-day Superior, Arizona, for sacred religious ceremonies that cannot take place anywhere else. Known in Apache as Chi’chil Biłdagoteel, Oak Flat is listed in the National Register of Historic Places and has been protected from mining and other harmful practices for decades. These protections were targeted in December 2014 when a last-minute provision was inserted into a must- pass defense bill authorizing the transfer of Oak Flat to the Resolution Copper company. Resolution Copper is a foreign-owned mining company that plans to turn the sacred site into a two-mile-wide and 1,100-foot-deep crater. The majority owner of Resolution Copper, #RioTinto, sparked international outrage when it deliberately destroyed 46,000-year-old #Indigenous rock shelters at one of #Australia’s most significant cultural sites.

“'Oak Flat is our Mt. Sinai—the most sacred place where generations of Apache have come to connect with our Creator, our faith, and our land,' said Dr. Wendsler Nosie Sr. of Apache Stronghold. 'We pray the Justices will protect Oak Flat and ensure that our place of worship is not treated differently simply because it lacks four walls and a steeple.”
Apache Stronghold—a coalition of Apaches, other Native peoples, and non-Native allies—filed this lawsuit in January 2021 seeking to halt the proposed mine at Oak Flat. The mine is opposed by 21 of 22 federally recognized tribal nations in Arizona and by the National Congress of American Indians. Meanwhile, national polling indicates that 74% of Americans support protecting Oak Flat. The Ninth Circuit ruled earlier this year that the land transfer is not subject to federal laws protecting religious freedom. But five judges dissented, writing that the court 'tragically err[ed]' by refusing to protect Oak Flat. After unsuccessfully asking all 29 judges on the Ninth Circuit to rehear the case, Apache Stronghold has filed their appeal to the Supreme Court.

"'Blasting the birthplace of Apache religion into oblivion would be an egregious violation of our nation’s promise of religious freedom for people of all faiths,' said Luke Goodrich, vice president and senior counsel at Becket. 'The Court should uphold its strong record of defending #ReligiousFreedom by ensuring that the Apaches can continue worshiping at Oak Flat as they have for centuries.'

"Apache Stronghold, San Carlos, Arizona, is a 501(c)3 nonprofit community organization of individuals who come together in unity to battle continued colonization, defend Holy sites and freedom of religion. We are currently in a battle to #SaveOakFlat from destruction by #ResolutionCopper (#BHP & #RioTinto). Chi’chil Biłdagoteel (also known as Oak Flat) is a sacred site for our Apache people and many other #NativeAmericans. This is a place that has special significance— a place where we pray, collect water and medicinal plants for ceremonies, gather acorns and other foods, and honor those that are buried here.

"We received the response from the 9th Circuit Court of Appeals. Our request to be heard by the full 29-judge panel was denied, none of the judges requesting a vote for rehearing. The Court amended its decision to discuss a previous Supreme Court decision that hadn’t been considered, and the 9th Circuit’s decision on the case remained closely divided, 6 to 5, with five dissenting judges and over 240 pages of opinions. We have now completed the 9th Circuit appeal, and the next step is petitioning to be heard by the Supreme Court. I want to thank everyone for your endless support and prayers. I know capitalism had began as far back as when trade began. For over 500 hundred years, we #IndigenousPeople of America, have suffered equally to the rest of the world. What had started in the beginning between good and evil will again face each other. One, to protect the greatest gift god gave the world or the other.,to destroy every human life and the spirit that #MotherEarth gives birth to. The question is, where will you stand in this moment? "Apache Stronghold is grateful for the outpouring of support for our efforts to protect Oak Flat. As our case heads to the Supreme Court, one way to support Apache Stronghold is for interested organizations to file an amicus brief (also called a friend-of-the-court brief) at the Supreme Court.

"The Prayer Journey to Supreme Court [began] July 12 beginning in Seattle, then to #ThackerPass, California, West coast, Arizona, New Mexico, .........and onwards toward Washington DC. This prayer journey will a couple months and visits many supporting organizations, Tribes, churches, religious sites and people for prayers as we cross this Country. The Supreme Court filing is set for September 11, 2024. Apache Stronghold vs United States."

MONTGOMERY, Alabama -- "The Apache Stronghold made a stop on their Journey of Prayer to the Supreme Court in the city of Montgomery, Alabama, the birthplace of the civil rights movement and home of the Dexter Avenue Baptist Church where Dr. Martin Luther King, Jr. first served as a full-time pastor.

"This church and Dr. King played a central role in uniting the local community in the struggle against what King called the evils of #materialism, #militarism, and #racism.

"The Stronghold was reminded that in 2013, Dr. #WendslerNosieSr., in honor of Dr. Martin Luther King, received the Presidential Award from the National Progressive Baptist Convention, becoming the first #NativeAmerican to receive the award.

"Dr. Nosie remembered how humbling it was that people in the East thought of him in the West and that these struggles for civil and human rights are connected to what this whole journey to the supreme court is all about.

"The struggle for freedom continues as Dr. Nosie reflected, 'It’s time to use all our combined voices for civil and human rights to fight for Mother Earth, the greatest gift God has given us.' So far on this journey we are happy to see that the churches are bringing in the importance of protecting Mother Earth. We have to make the air, the water, the earth a priority because we will only be able to stop the shattering of human existence by protecting God’s greatest gift, our Mother Earth."
